Terms and Conditions of the Agreement

The Terms and Conditions affect your legal rights in relation to Carland Auction. You should carefully read the full text of the Terms and Conditions before accepting them.

By registering as a Participant and/or placing bids at Carland Auction, you represent and warrant to Carland Auction that you have read and fully understood the Terms and Conditions and agree to be bound by them in all respects.

Vehicles offered for sale on the carland.auction website are sold via our patented online auction sales platform. Only Participants with a "Basic" or "Premium" plan and a good reputation are allowed to view lots and place bids on vehicles.

Carland Auction's platform uses the BID4U feature. Carland Auction uses BID4U to make remote bidding easier and more efficient. Simply review the lot carefully and enter a Preliminary Bid for the selected lot, representing the maximum amount you are willing to pay for the vehicle, and BID4U will place bids on your behalf up to your maximum bid during the auction period.

BID4U may only increase the bid by one step (50,000 Korean Won) from your maximum price to maintain your position as the highest bidder.

Preliminary Bids

Open bidding allows participants to place bids before the auction begins, either via the website or at Carland Auction bid stations.
Once vehicle information appears on the auction, participants may place preliminary bids at any time up to one hour before the auction starts. Preliminary bids will be reflected in the personal account.
Bidders indicate the maximum price they are willing to pay for a vehicle. The lot may be won at a lower price if bidding stops before reaching your maximum, or lost if bids exceed your maximum. At the end of the auction, you will receive notification of the results, and the results will also be reflected in your personal account.
Before the auction starts, participants can view the vehicles online and inspect them at auction locations using the "off-site inspection" service.
Once a bid is placed, it cannot be withdrawn, deleted, or canceled.

Bidding via a "Registered Broker"

If you are not registered under a "Premium" plan to bid independently, you may contract a Registered Broker to participate in auctions on your behalf for a fee.
By contracting with a Registered Broker, you acquire the vehicle through the Broker.
If you decide to contract a Registered Broker for bidding, you should carefully review the terms of the services offered to ensure they meet your vehicle acquisition needs.

"Buy Now"

Vehicles are offered with a "Buy Now" option. This option allows you to purchase vehicles from dealer lots at the price set by the seller. After clicking the "Buy Now" button, the Participant will be redirected to www.carland-motors.com (Encar dealer vehicles).

"Make an Offer"

Subscribe to notifications about new vehicles, new arrivals, hot offers, auction start dates, live auction streams, auction archives, and auction news. This option allows the Participant to receive all the newest and most useful offers. Telegram channel.

ALL AUCTION VEHICLES ARE SOLD ON AN "AS IS" BASIS.

All Participants agree that auction vehicles are sold on an "AS IS" basis.

Once a vehicle is removed from the auction premises, it is accepted on an "AS IS" basis, and under no circumstances shall Carland Auction be liable for any subsequent claims for compensation or damages of any kind or nature.

VEHICLE EXPORT

All vehicle export operations are governed by the laws and regulations of the Republic of Korea, including, without limitation, the Foreign Trade Regulations (FTR) and the Export Administration Regulations (EAR). Any deviation from Korean law is prohibited. Carland Auction agrees not to perform exports or re-exports, and not to allow re-export of purchased vehicles to any country subject to restrictions and/or embargoes listed by the U.S. Department of State.

Export Requirements

Carland Auction acts as the "responsible exporter" or other responsible party (if required) for all vehicles under all export laws to the destination countries and is responsible for compliance with all export regulations, including preparing and submitting all necessary documents to the appropriate governmental authorities, paying all export fees, duties, taxes, and other charges applicable during vehicle export, and fulfilling all customs requirements.

PARTICIPATION

Eligibility to Become a Participant

You may register as a Participant if you are at least 18 years old.

Participant Types

To participate in auctions, you must be a Participant in good standing.
Guest account Participants under the "Basic" plan (7-day trial) may only view auction lot lists, starting prices, and auction sheets, but cannot place bids or acquire vehicles unless membership is upgraded to "Premium."
To place a bid on a vehicle, you must upgrade to a "Premium" plan account.
Premium plan Participants must provide a security deposit upon registration and submit copies of a valid government-issued photo ID as well as business documentation.

Account Activity

Participants are responsible for all account activity, including, without limitation, all Preliminary Bids placed using their username and password on the Carland Auction website. The Participant account may not be transferred or assigned to another individual or organization. Participants must immediately notify Carland Auction in writing if their account, membership ID, username, or password is used without permission. Participants are responsible for all activity and expenses incurred prior to Carland Auction receiving written notice of unauthorized activity.

Compliance with Laws

Participants must comply with all applicable laws, regulations, rules, and directives governing their use of Carland Auction services, including, without limitation, laws relating to transportation, storage, transfer, resale, dismantling of purchased vehicles, or changes to title documents. The Participant is solely responsible for paying all fines, penalties, fees, and other amounts assessed by governmental authorities for violations (collectively "Vehicle-related Fines"), including, without limitation, parking or toll violations, tax liens, towing fees for improperly parked vehicles, and storage charges. Each Participant agrees to indemnify and hold Carland Auction harmless for all such Vehicle-related Fines. Failure to comply with applicable laws and regulations, including timely payment or settlement of unpaid Fines related to purchased vehicles, may result in suspension or revocation of the Participant's rights to acquire vehicles at Carland Auction.

Auction Site Rules

Participants and their agents, representatives, and guests visiting auction sites must comply with all site rules, requirements, and instructions. Participants may not remove any items, including envelopes or documents inside a vehicle, and must notify auction representatives of such items. Any person caught stealing or damaging vehicles will be arrested and prosecuted to the full extent of Korean law. Such actions include theft or damage to any vehicle components, items, or keys.

Membership Cancellation

Carland Auction reserves the right to deactivate, suspend, or cancel a Participant account for any reason at its sole discretion.

Marketing and Advertising Materials

Participants agree that they have consented to receive marketing and advertising materials by mail, email, newsletters, fax, app, social media, media, SMS, or other communication methods valid at the time.

FEES, PAYMENT, AND DELIVERY

Fees

All Participants agree to pay the Deposit and other applicable fees when purchasing each vehicle. Registered Participants can view the current fee list in their "Personal Account" on Carland Auction. The Participant is fully responsible for paying fees before participating in vehicle auctions.

Payment

Vehicle and fee payments may be made by bank transfer, cash, or payment order.
Participants agree to be personally responsible for transfers or payment orders if not paid.
The Participant must make payment within two days after the invoice for the vehicle and related fees is issued.
Any Participant with multiple unpaid invoices, resubmission fees, or insufficient funds will be automatically suspended, and a security deposit will be required in an amount determined solely by Carland Auction. Carland Auction retains this deposit as a guarantee for payment of unpaid invoices. The deposit will be returned upon request if all invoices are paid, but the Participant account will remain suspended. If the Participant fails to pay any invoices, Carland Auction may use the deposit to cover the outstanding debt.

Self-Delivery

With prior approval from Carland Auction, Participants may arrange international shipping of purchased vehicles themselves. Export handling fees are not waived for self-delivery.

Vehicle Payment

All vehicle fees and payments must be made prior to shipping to the port/destination.

Premium Payment Priority

Payments made by Participants to Carland Auction will be applied in the following order: Premium Participants must provide a $3,000 USD security deposit and pay a 10% deposit of their preliminary bid for each lot before auction start. Deposits are applied toward vehicle payment. Payment must be made within two days after invoice issuance.
Participants agree that Carland Auction is not obligated to release vehicles or title documents until all fees are fully paid.

Premium Participant Security Deposit

Carland Auction returns the security deposit upon request if all invoices and fees are fully paid, but the Participant account level will be downgraded to Basic. If a Premium Participant fails to pay any invoices, Carland Auction may use the security deposit to cover outstanding debt.

Security Deposits for Basic Plan Participants

Before a Basic Plan Participant may place a bid on a vehicle, Carland Auction may require a security deposit.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the Participants and Carland Auction regarding this subject matter. No representations, warranties, or promises other than those set forth herein are provided.
